Thanks for booking your gaming event with Next Level Gaming LLC (“Next Level Gaming”)! The Next Level Gaming staff is committed to ensuring your event is as fun and as safe as possible. Next Level Gaming takes pride in providing high quality gaming services and appreciates your business! Please read the Terms and Conditions below, and the Liability Waiver carefully, as they contain important information regarding your Next Level Gaming event. Otherwise, Next Level Gaming will assume you do not need any further clarification and that you accept the below Terms and Conditions upon booking your event.

TERMS AND CONDITIONS

COVID-19 AWARENESS: We have ensured that all of our Next Level Gaming staff members have been fully vaccinated with two doses of their respective vaccines. We will have hand sanitizer available at every event, and strongly encourage all event guests to sanitize their hands between gaming sessions. Next Level Gaming is actively monitoring and adapting Covid protocols based on guidelines provided by the Center for Disease Control, as well as adopting all Federal, State, County, and City recommendations. For the safety of you, your guests, and our team members, please encourage all of your guests who have not been fully vaccinated to wear a mask.

USE OF VIRTUAL REALITY DEVICES: Oculus VR, LLC, and PlayStation VR, do NOT recommend that children under the age of 13 use the VR headsets. The use of PlayStation VR may cause some players to experience motion sickness or may have other disorienting effects (dizziness, nausea, seizures, fear of heights, bumping into objects, etc.). Any user of VR acknowledges the benefits gained from the use of VR and is done at the user’s own risk of injury. In exchange for the benefits gained from the use of VR, all users must read, understand, acknowledge, and accept the Next Level Gaming’s Liability Waiver provided upon booking of the event.

PARTIES & SPECIAL EVENTS: Next Level Gaming staff will arrive approximately 90 minutes before the scheduled event start time in order to identify the gaming event space, evaluate and ensure that there is an adequate power source, and to begin event set up in the play area. For outdoor events, we will need a level area to set up our tent(s) and table(s). Please double check the address we will be using. You are responsible for providing any additional location information, such as, acceptable parking arrangements, and breakdown areas for event set up and take down.

CHURCH, SCHOOL, NON-PROFIT AND CITY EVENTS: If you would like promotional materials, W-9, Liability Insurance documents or if you need our staff to fill out vendor information, please email Next Level Gaming at mail2nextlevelgaming@gmail.com.

CANCELLATION POLICY: A NON-REFUNDABLE required deposit of $199.00, or other amount indicated upon booking, will be charged to secure your reservation. In additional Fuel Surcharge will also be charged at this time for any county outside of Erie that is included within our service area (please see Fuel Surcharge section below for charges). The remaining balance will be due 72 hours prior to the scheduled event start time, unless the event is canceled before this time. This is a NON-REFUNDABLE payment. Next Level Gaming will make every reasonable effort to reschedule your event. However, upon booking your event, you acknowledge that there is no obligation, beyond a reasonable effort, for Next Level Gaming to reschedule a cancelled event.

REFUND: Cancellation of the event by the client prior to the 72-hour payment balance window will result in a refund of all payments made less the NON-REFUNDABLE deposit of $199.00 (or other amount indicated upon booking).

FORMS OF PAYMENT: All major credit cards are accepted. Cash is also accepted. Checks are acceptable. However, all payment options must clear at least 3 business days prior to the event.

PRIVACY POLICY: Next Level Gaming is committed to protecting your privacy. We will use the information that is collected in our booking system for reservation and direct contact purposes ONLY. We strive to make your experience with Next Level Gaming as simple as possible and will make every effort to enhance your overall experience with our company. We will not sell, trade, or rent your personal information to others. We may use the email you provided to reach out to you for Next Level Gaming customer satisfaction surveys or additional information pertaining to your event.

TRAVEL AND FUEL SURCHARGE FEE: Please keep in mind a fuel surcharge will apply for all locations in the extended service area outside of Erie County. This Fee, if it applies to you is due in addition to the $199.00 minimum security deposit fee. Our extended service area includes the following counties with their respective fuel surcharges: Allegheny – $75, Armstrong – $70, Beaver – $70, Butler – $60, Clarion – $70, Crawford – $25, Elk – $100, Forrest – $50, Indiana – $85, Jefferson – $80, Lawrence – $55, McKean – $70, Mercer – $40, Venango – $55, Warren – $45, Westmoreland – $90. The Fuel Surcharge fee will be clearly indicated to you upon booking your event.

LOCATION (APPLIES TO OUTDOOR EVENTS ONLY): The customer is required to provide a relatively flat, safe area for Next Level Gaming to set up their tent(s), and table(s). If the location is deemed unsafe for the customers, players or other guests at time of arrival, Next Level Gaming will request an alternate location be provided. If an alternate location cannot be reasonably found during the event set-up, we will allow the event to be rescheduled for a later date, with an additional $50 rescheduling service fee.

SEVERE/INCLEMENT WEATHER (APPLIES TO OUTDOOR EVENTS ONLY): There may be occasions when the weather does not cooperate with your scheduled party. In the event of severe weather, such as lightning, very high winds, flooding and/or extremely heavy rains, we reserve the right to reschedule your service to guarantee the safety of you, your guests, our staff and equipment. If the threat of these storms threatens your event and you are aware in advance, such as, a likely severe thunderstorm, please notify us and we will begin the rescheduling process.

SUPERVISED CHILDREN: Next Level Gaming does not require a parent to be present in the play area, although one must be available on the grounds and readily accessible if needed. We will provide a knowledgeable Next Level Gaming staff member who will assist your children in making sure that their party is a “Next Level” party!

ALCOHOL/DRUGS: Although alcohol is not prohibited, we reserve the right to refuse, cancel or shut-down an event when the consumption of alcohol creates a disturbance. Drugs of any sort will not be tolerated in or around Next Level Gaming’s equipment. Any observed use of illegal drugs, narcotics or legal drugs used in an illegal manner will result in the termination of the party immediately and law enforcement will be contacted.

SMOKING: Next Level Gaming does not allow smoking in or around our play area. Please keep any smoking activity away from the play area.

DAMAGE/INJURY/THEFT: Next Level Gaming reserves the right to charge the client’s credit card for damages and/or theft to Next Level Gaming’s equipment resulting from the careless, negligent, or willful actions of the client and/or their guests. Next Level Gaming and staff will not assume responsibility for any injuries sustained on the client’s property or their designated event location. All liability for damages or injuries is the sole responsibility of the client and/or host. Please refer to Next Level Gaming’s Liability Waiver for further information.

FOOD/DRINK: Next Level Gaming does not allow any food or drinks in the play area. Please have your guests consume them outside of the play area prior to entering.

PICTURES: While your party is in effect, the Next Level Gaming team member will be taking pictures of the party from in and around the play area. You will be able to view these pictures on the Next Level Gaming Facebook Page and copy them to your files. If you do not want pictures taken and placed on Facebook, there will be an area in our booking system to notify us of that fact or please write to Next Level Gaming in advance of your event at mail2nextlevelgaming@gmail.com.

TIPS: Next Level Gaming staff will be there to make sure that your group is making the most of our high-tech fun. Our staff is provided to inspire, entertain, and maintain a safe environment. Tipping our staff is encouraged as a gesture of appreciation but is not required.

VIDEO GAME RATINGS: Next Level Gaming has taken the time to rate each preset party package with the highest maturity rating contained therein. All party package that contains a “T” or “M” rating, will be clearly indicated in the booking system. It is your responsibility to understand the rating system and the appropriate ratings for your event before you confirm your preference upon booking. Next Level Gaming WILL NOT play any “T” or “M” rated games without consent of the client. By indicating your event rating preference in the booking system, you acknowledge that you understand and consent to the appropriate game ratings for your event. EXTENDED TIME: Requests for extended play time beyond the agreed upon hours of service shall be accommodated, if feasible, for an additional fee of $125.00 per hour.

ACKNOWLEDGEMENT: By submitting payment (deposit or otherwise) and upon receipt of your invoice, you acknowledge that you have read the Terms and Conditions and Next Level Gaming’s Liability Waiver carefully and agree to abide by them.
